Sexual harassment case against chief Justice Ranjan Gogoi
The Supreme Court has closed the hearing initiated against former Chief Justice (CJI) Ranjan Gogoi on his own notice (automatic cognizance) in the sexual harassment case. The court said that two years have passed since the case and the possibility of obtaining electronic records in the investigation of the conspiracy is very less. Supreme Court lawyer Utsav Bains had claimed the conspiracy behind the sexual abuse allegations against Justice Gogoi.
A bench headed by Justice Sanjay Kishan Kaul started hearing in the case on Thursday after 1 year and 9 months. The court made this decision based on the report of former Justice AK Patnaik. He was tasked to investigate the conspiracy.
The court said that Justice Patnaik's report has accepted the conspiracy and cannot be dismissed. Actually, Justice Gogoi made some tough decisions while CJI which give strength to the conspiracy. The report also cites input from an Intelligence Bureau. It states that many people were unhappy with Justice Gogoi for advancing the National Register of Citizens (NRC) in Assam.
Hearing started almost two years ago
The final hearing of the case was held on 25 April 2019 by a bench of Justice Arun Mishra, Justice Rohinton Fali Nariman and Justice Deepak Gupta. The court had then decided to investigate whether the charge was a conspiracy to harm the CJI and the dignity of the court.
Former Supreme Court employee accused
A former Supreme Court woman employee accused former Chief Justice Gogoi of sexual harassment. In 2018, the woman was posted as a Junior Court Assistant at Justice Gogoi's residence. The woman claimed that she was later laid off.
The woman had sent a copy of her affidavit to 22 judges. On this basis, four web portals published news about the Chief Justice. The hearing started in the Supreme Court on the matter in April 2019.
The court also said that two years have passed since the case and the possibility of obtaining electronic records in the investigation of conspiracy to implicate Gogoi is very less. In fact, Supreme Court lawyer Utsav Bains claimed to be the conspiracy behind the sexual abuse allegations leveled against former CJI Ranjan Gogoi.
Significantly, in the year 2019, a woman made sexual harassment allegations against former CJI Ranjan Gogoi. Taking suo motu cognizance, the Supreme Court ordered an inquiry into the matter. Also said that the allegations are very serious. We have to find out the truth. If we close our eyes, the trust of the country will be lost. After this, Justice Patnaik was entrusted with this responsibility.
